Please CAREFULLY read the following:

I understand and agree as follows:

1. That Donald A. Gardner Architects, Inc. or Donald A. Gardner, Inc. [DAG] designed and holds the copyrights to the above described house plan.

2. That the computer files which I am purchasing are for the sole use of a CAD user, (i.e., architect, builder or owner) for the limited purposes of making modifications and producing construction documents to build this home.

3. That this limited license allows me to construct this plan an unlimited number of times with this plan purchase.

4. That in consideration of the amount paid to DAG by me or a person duly qualified, DAG hereby grants me a limited license to make changes to the design on the computer files for the purpose of meeting my personal preference or in order to comply with state and/or local building codes.

5. I agree to keep the DAG copyright notice on the drawings. The copyright notice is "copyright management information" under the Digital Millennium Copyright Act, and Donald A. Gardner Architects, Inc. and/or Donald A. Gardner Inc. requires its inclusion on all copies to discourage and police copyright infringement. Unauthorized reproduction or usage of these documents or removal of the notification is subject to prosecution.

6. That the limited license granted with these files may not be used by, sold, or transferred to any other party. Purchaser does not have the right to grant others the right to use the limited license herein granted; or to convey or otherwise transfer the rights granted herein. It being understood that the rights herein granted are personal to the purchaser.

7. That I agree to have the CAD user agree to and sign these provisions. Print

8. That I agree to retrieve the computer files from the CAD user.

9. That DAG is not responsible or liable for any modifications. I agree all responsibility and liability for such modifications and the results of those modifications will be assumed by me and the person making the modifications for me, and that if the purchaser is not the end user, the purchaser of the computer files assumes the responsibility of the end user.

10. That since the drawings on the computer files were generated with AutoCAD, DAG does not guarantee the compatibility with any other CAD system.

11. That the computer files and any computer files previously purchased are not returnable or exchangeable under any circumstances.

12. That DAG, unless directed otherwise, upon receipt of this completed document and payment, will forward the computer files to the purchaser whose name and address is shown in this agreement.

13. That except to the extent preempted by federal law, this agreement will be construed and controlled under the laws of the state of South Carolina without regard to any conflicts of laws.

14. That I am given permission to make unlimited copies/prints of the plan from the computer files as necessary. No other reproduction or display is authorized.

15. If any standard options were included in the order (such as an unfinished basement foundation, slab foundation, 2x6 wall conversion or full reverse) only these options will be included in the CAD file. The purchaser does not receive both the basic plan as designed AND the optional standard modifications or any combination of those options. If additional files are needed showing the plan as originally designed or with a different combination of options, an additional file fee applies.

16. About building codes: Each plan is designed to be consistent with CABO One and Two Family Dwelling Code or the International Residential Code in effect at the time the plan was created, but DAG does not warrant such conformity. Modifications may be necessary to meet applicable building codes, ordinances, local climatic, and geographical design criteria. Consult a builder, architect or other construction professional as necessary. DAG Specifically disclaims any responsibility for ensuring the plans, and/or any house built using the plans, satisfies local or other applicable building codes. Determining and complying with all applicable codes is your responsibility. Manufacturer instructions should be followed for all materials, appliances, and systems. Heating/air conditioning layouts, plumbing pipe layouts, and electrical wiring layouts are not included.Consult a local mechanical contractor for systems suitable for local climate conditions.

Additionally, stock plans do not have a professional stamp attached. If your building department requires one, they will only accept a stamp from a professional licensed in the state where you plan to build. In this case, you will need to take your house plans to a local engineer or architect for review and stamping.
